1. Acceptance of Terms
By downloading, installing, or using the "Skoop" mobile application (the "App") or accessing our website at theskoop.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Skoop provides a locally curated feed of events and activities (the "Service"). The App allows users to browse events based on location, track preferences ("likes/dislikes"), and receive notifications. Users may access the App for free or purchase a "Premium Access" subscription for unlimited features.
3. Event Content and Accuracy (Crucial Disclaimer)
The events displayed on Skoop are aggregated from public sources across the web. Skoop is an information aggregator, not an event organizer.
By using the App, you acknowledge and agree that:
- No Guarantee of Accuracy: While we strive to provide up-to-date information, we cannot guarantee the accuracy, completeness, or timeliness of event details (including dates, times, locations, pricing, or descriptions). Event organizers may change or cancel events without notice to Skoop.
- User Discernment Required: Information regarding events may differ from the actual experience. Content found on the public web may occasionally be mislabeled or inaccurately described. You are responsible for verifying event details with the official organizer or venue before attending.
- Suitability: We do not warrant that the events listed are suitable for all ages or audiences. You must exercise your own judgment and discernment regarding the suitability of any event.
- Third-Party Links: The App may contain links to third-party websites (e.g., for ticket purchases). We do not control these sites and are not responsible for their content, privacy policies, or practices.
4. Accounts and Security
To access certain features, you may be required to register using an email address or a third-party provider (Google/Apple). You agree to:
- Provide accurate and current information.
- Maintain the security of your login credentials.
- Accept responsibility for all activities that occur under your account.
5. Premium Subscriptions and Payments
- Subscription: Users may subscribe to "Premium Access" for unlimited access to events.
- Billing: Payments are processed through the app store provider (Apple App Store or Google Play Store) associated with your device.
- Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period in your account settings.
- Cancellations & Refunds: Cancellation and refund requests are subject to the policies of the respective App Store or Play Store. Skoop does not directly handle refunds for in-app purchases.
6. Prohibited Use
You agree not to use the App to:
- Violate any applicable laws or regulations.
- Infringe upon the intellectual property rights of others.
- Attempt to reverse engineer, scrape, or extract data from the App's source code or database.
- Transmit viruses, malware, or any other malicious code.
7. Intellectual Property
- Skoop Rights: The Skoop name, logo, design, code, and interface are the exclusive property of Skoop.
- Content Rights: Event names, images, and descriptions displayed in the App remain the intellectual property of their respective owners/organizers. Skoop claims fair use or license to display this public information for informational purposes.
8. Limitation of Liability
PLEASE READ CAREFULLY:
TO THE FULLEST EXTENT PERMITTED BY LAW, SKOOP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- INACCURACIES: ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT.
- PERSONAL INJURY: ANY PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF ANY NATURE WHATSOEVER RESULTING FROM YOUR ACCESS TO OR USE OF THE APP, OR YOUR ATTENDANCE AT ANY EVENT LISTED ON THE APP.
- INTERRUPTIONS: ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP.
- DATA LOSS: ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9. Service Termination and Discontinuation
IMPORTANT NOTICE:
Skoop reserves the right to modify, suspend, or discontinue the App and any associated services, in whole or in part, at any time and for any reason, with or without notice. By using the App, you acknowledge and agree that:
- No Refunds Upon Termination: If Skoop discontinues the Service or terminates your access to the App, you will not be entitled to any refund of subscription fees or any other compensation, unless required by applicable law or the refund policies of the App Store or Play Store through which you purchased your subscription.
- No Obligation to Provide Notice: While we may attempt to provide advance notice of service discontinuation, we are under no obligation to do so. Service may be terminated immediately without prior warning.
- No Liability for Discontinuation: Skoop shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, regardless of whether you are a free user or paying subscriber.
- Data Retention: Upon termination or discontinuation of the Service, Skoop has no obligation to retain, store, or provide you with any data, preferences, or content associated with your account. You are responsible for exporting any data you wish to retain before the Service ends.
- Subscription Cancellation: Active subscriptions may be cancelled by Skoop at any time. Any refunds for prepaid subscription periods will be handled according to the applicable App Store or Play Store policies, and Skoop makes no additional guarantees beyond those required by law.
- Right to Terminate Individual Accounts: Skoop reserves the right to terminate or suspend your individual account at any time for violation of these Terms, fraudulent activity, or any other reason deemed appropriate by Skoop in its sole discretion.
BY CONTINUING TO USE THE APP, YOU EXPRESSLY WAIVE ANY CLAIMS AGAINST SKOOP ARISING FROM THE TERMINATION, SUSPENSION, OR DISCONTINUATION OF THE SERVICE OR YOUR ACCOUNT.
10. Indemnification
You agree to defend, indemnify, and hold harmless Skoop from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of and access to the App.
- Your violation of any term of these Terms.
- Your attendance at any event discovered through the App.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Insert Your State/Country], without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
